TERMS AND CONDITIONS

Breville UK and Marmite Joint Terms and Conditions for Giveaway 

1. Breville UK and Marmite’s prize draw is open only to residents of the United Kingdom aged 18 and over as at the time of the prize draw except employees of the Promoter, their families, agents or anyone professionally connected with the promotion. Employees must obtain their employer’s consent to enter.

2. To enter the prize draw, you must adhere to the following conditions. You must follow both @brevilleuk and @Marmite on Instagram, like this post and comment by tagging a friend. Multiple entries are accepted. Entries will be only accepted from 5:30pm GMT 12 th January 2023 and 11:59pm GMT on 19th January 2023. After the end date, no further entries to the prize draw will be permitted. Failure to comply with any part of this clause will disqualify the respective entries from the prize draw.

3. There is no entry fee and no purchase necessary to enter the prize draws run by Breville UK and Marmite.

4. To enter, entrants must follow the instructions on the giveaway post and comply with these terms and conditions.

5. Obscene or inappropriate entries will not be accepted, and the Promoter reserves the right to reject any entries for any reason at its sole discretion.

6. The winning prize is the selection of Marmite spreads (6 spreads including 2 x Marmite original flavour, 2 x Marmite dynamite chilli flavour, 2 x Marmite truffle flavour) as outlined in the giveaway caption copy and imagery, and the Breville UK Deep Fill Toastie Maker as outlined in the giveaway caption copy and imagery.

7. One winner will be selected at random using https://www.wask.co/instagram-giveaway-comment-winner-picker from all valid entries on 20th January 2023. The winner will be notified by private message via the Instagram account they used to enter the prize draw. If the winner cannot be contacted or does not claim the prize within 7 calendar days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.

8. The winner’s prize will be sent by 24th January 2023 via tracked delivery in the United Kingdom, and only following the winner supplying delivery details to the Promoter.

9. To the extent permitted by applicable law, the Promoter’s liability under or in connection with the prize draw or these terms and conditions shall be limited to the value of the prize in question.

10. Each entry:

a. must be suitable for display and publication online and should not be obscene or indecent (including but not limited to nudity, pornography or profanity), it must not contain defamatory statements or words or symbols that are offensive either generally or to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group. It must not include threats to any person, place, business or group, it must not invade privacy or other rights of any person, firm or entity, and it must not in any other way violate applicable laws and regulations or network standards;

b. must not contain or refer to any products other than those of [Unilever / insert name of brand(s)] and it must not contain or reference any third party trade marks or logos (other than those of Marmite or Breville unless such inclusion is merely incidental and is not unduly prominent and as long as it is included with due cause and in such a way that it does not take unfair advantage of any third party trade marks; and

c. must be the entrant’s own work and must not contain any copyright protected works (other than as owned by the entrant).

11. Entries received in connection with this promotion may be reviewed by the Promoter or a third party moderator after they have been placed online to confirm they comply with these terms and conditions. If any such entries are or could reasonably be construed as being unlawful or contrary to these terms and conditions, we may remove them from [insert name of Twitter / Facebook / Instagram account / website url] immediately. The Promoter reserves the right to delete or remove any published entries from [insert name of Twitter / Facebook / Instagram account / website url] at any time without prior notice to entrants.

12. If you submit an entry that includes material the rights in which are owned by a third party, including intellectual property rights such as copyright and trade marks, you will be responsible for any legal action that party may take against you.

13. Entrants shall indemnify and hold the Promoter and their respective affiliates, directors, agents, or other partners ("the Indemnitees") harmless from any claims, actions, proceedings, costs (including reasonable legal fees) and expenses brought or asserted by a third party against any of the Indemnitees arising as a result of the Promoter's use of the entrant's submission including but not limited to any breach of third party intellectual property rights.

14. By participating in this promotion, you agree to release, discharge and hold us harmless from any and all injuries, liability, losses and damages of any kind resulting from your participation in this promotion (save that nothing shall limit our liability for fraud, or for death or personal injury caused by our negligence.

15. To the extent permitted by applicable law, the Promoter shall not be liable under or in connection with these terms and conditions, the prize draw or any prize for any indirect, special or consequential cost, expense, loss or damage suffered by a participant even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the participant and the Promoter and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.

16. Responsibility is not accepted for entries lost, damaged or delayed as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.

17. Prizes are non-negotiable, non-transferable and non-refundable. No cash alternative is available. Where a prize becomes unavailable for any reason, the Promoter reserves the right to substitute that prize for a prize of equal or higher value.

18. In the event of unforeseen circumstances beyond the Promoter’s reasonable control, the Promoter reserves the right to cancel, terminate, modify or suspend the prize draw or these terms and conditions, either in whole or in part, with or without notice.

19. Copyright in all entries shall be owned by the Promoter.

20. These terms and conditions are governed by English law and subject to the non-exclusive jurisdiction of the English courts.

21. Personal data supplied during the course of this prize draw will only be processed as set out in the Promoter’s Privacy Policy. The Promoter, and any of its affiliates acting as a Controller under relevant data protection rules and regulations, will retain your Personal data solely for the further course and completion of this prize draw, for participation management and contact with winners. This includes full name and address. Your Personal Data will be treated in confidence and will not be disclosed to any third party that are not affiliated to Promoter unless required for the proper conduct of this prize draw. You have a right to access, modify or remove your personal data by using our Data Privacy Enquiry form. Your personal data will be destroyed after the end of this prize draw. 22. THIS PRIZE DRAW IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH INSTAGRAM. BY ENTERING THIS PRIZE DRAW, YOU ACCEPT TO RELIEVE INSTAGRAM FROM ANY RESPONSIBILITY. THE INFORMATION SENT BY THE PARTICIPANT WILL BE PROVIDED TO THE PROMOTER ONLY AND NOT TO INSTAGRAM.
